Terms and Conditions
BY USING OUR SERVICE YOU SIGNIFY YOUR ACCEPTANCE TO THESE TERMS OF USE. IF YOU DO NOT AGREE WITH ANY OF THE TERMS OF USE BELOW, PLEASE DO NOT USE OUR SERVICE. EARTH LIMOS AND BUSES RESERVES THE RIGHT, AT ANY TIME, TO MODIFY, ALTER OR UPDATE THESE TERMS OF USE. YOU AGREE TO BE BOUND BY SUCH MODIFICATIONS, ALTERATIONS OR UPDATES. RESERVATIONS: We recommend that our clients reserve a car ahead of time (at no additional charge) to be guaranteed a car at time of pick up. We can provide you with a car at short notice by phone upon availability.

CANCELLATION: Earth Limos and Buses require a 7-­‐day cancellation policy for all Federal Holidays & Special Events (defined below). For Federal Holidays & Special Events, Earth Limos and Buses will charge a 50%, non-­‐refundable deposit on all transportation reservations. The cancellation fee shall be the entire deposit, unless request is cancelled more than 7 days from departure destination. All other cancellations require a notice of cancellation not less than twenty-­‐four (24) hours prior to the departure time originally agreed upon for Stretched Limousines and Party Buses and (1) hour cancellation for Sedan’s and SUV’s. If notice of cancellation is not timely given a charge equal to the minimum charge for the service originally requested will be charged by the carrier.

SPECIAL EVENTS: Special Events are defined as High school proms, high school homecomings, Formula One, NASCAR, NFR (National Finals Rodeo), EDC (Electric Daisy Carnival), CES (Consumer Electronics Show) and all events forecasted by the Las Vegas Convention and Visitors Authority with an estimated visitor count of 60,000 people or more.

HOLIDAYS: Holidays are defined as New Year’s Eve and New Year’s Day.

NO SHOWS: If you do not see your driver at a certain pick up point do not leave before calling our dispatch office. You must call 725-777-3333 so that we can direct you to your chauffeur. If you leave without calling you will be billed for the full price of the ride (No-­‐show fee). If we do not hear from you,
the driver will wait up to 30 minutes at hotels or residential pickups and up to 60 minutes for inside airport pickups after the scheduled pickup time. We will then try to reach you by calling you on the contact number that you provided in your reservation, or the contact person’s contact number depending on the nature of the pickup, we will attempt to call your name on the airport intercom paging system in some cases. If we do not get a response we
will then release the car and you will be billed for a No Show which will be the Full Price of the ride (No-­Show Fee) plus any additional waiting time charges. To authorize the driver to wait please call the office to authorize his wait. If we do not hear from you after the time frame, we will contact you again, if no contact is made you will get billed for the ride plus the waiting time. Therefore A “No Show” fee is equal to the trip cost plus the applicable wait time fee and will be charged when the passenger fails to arrive at the designated location. If you cannot locate your Driver, Please call (725) 777-3333 to avoid a “No Show” fee.

DAMAGES RESULTING FROM YOUR ACTS: Earth Limos and Buses will charge you the cost of cleaning the vehicle as a result of you or your party getting sick in, or damaging the vehicle. You will be held responsible for all damages caused by the negligence of your group,  including a vomit cleaning charge of $500 dollars United States Currency for our buses and a $250 dollars United States Currency for our Limousines, SUV’s, and Sedans. There is no smoking in any of our vehicles. Failure to comply with our no smoking rule will constitute a fee of $100 dollars United States Currency which will be payable immediately or the reservation will be terminated immediately. Upon receipt of the $100 dollars United States Currency and the completion of the reservation the vehicle will be taken out of service to be detailed to remove the smoke odor. You also agree and acknowledge paying all the related fees and charges to get the vehicle back to its normal working condition.

CREDIT CARD TRANSACTIONS: We will authorize the card given at the time of reservation to guarantee funds availability. The authorization will show as (Pending funds) if you check your credit card account statement online. The authorization amount will be for the full amount of the reservation. We will charge your card 24 hours prior to the commencement of your reservation for the total amount due. All receipts are sent by email. Additional time added to the reservation will be charged to your credit card on file at the end of the reservation.

DISPUTES: For Corporate clients with established corporate accounts, all charges of an invoice will be considered correct and due upon receipt, unless we receive an objection within 10 days from the invoice date. Copies of the charge under dispute should be faxed or mailed to us and the disputed charges or items should be indicated. All disputes initiated after the allowed time frame period will be considered final and non‐refundable.

For Individual accounts and personal profiles, all charges applied to the customer’s credit card will be considered correct, unless we receive an objection within 15 days from the charge date in writing. Copies of the credit card statement or credit card slips or vouchers should be faxed or mailed to us and
the disputed charges or items should be indicated. All disputes initiated after the allowed time frame period will be considered final and non-­‐refundable.

REFULSAL TO CARRY PERSONS OR PASSENGERS: The driver of the transit vehicle shall have the right to refuse to carry any person or require any passenger to leave the vehicle if the person or passenger is intoxicated, unruly, is believed to be under the influence of narcotics, is believed to present a danger to the health or safety of the driver, or if verbal threats of any kind are made toward any staff member. ANIMALS: All animals must be in a kennel with the exception of Service Animals providing assistance to handicapped customers.

RATE CHANGES: Earth Limos and Buses can change rates and any of the services, charges, costs, fees and expenses with proper notice no less than 7 days. The client will have the opportunity to cancel free of any charges if the client does not agree with new changes.

ITEMIZED INVOICES: For Corporate clients with established accounts, Paid Itemized invoices will be sent after the work has been completed and only when requested. For Individual accounts itemized invoices are sent only when requested.

PAYMENT DUE DATES: For Individual accounts all payments will be received before the ride is executed. The total will be charged to client’s credit card 24 hours before the beginning of ride. POINT TO POINT FARES: Those are prices calculated based on mileage and zones and zip codes.

PARKING: All parking fees and other airport regulatory fees are additional (usually $6.00 to $15.00 depending on time). We do not charge them; these fees go directly to the airport parking lots.

HOURLY RATES: Vehicles are rented by the hour. Once the first hour has been completed you will be charge in 30 minute increments. Certain zip codes require additional charges due to vehicle travel time to and from the zip codes.

WAITING TIME: A 30 minutes grace period is allowed following the reported flight arrival time for airport pickups of domestic or international flights.
No grace period is granted for all other pick-­ups. Waiting time will be charged at 30 minute increments after the grace period.

Earth Limos and Buses check all domestic and international flights two hours before the driver is dispatched. Any delays will be tracked so that the billing starts from the official time of arrival (ETA).

STOPS: Price per stop varies based on distance and location; please call us to request pricing. Courtesy stops may be approved at the discretion of the customer service representative (CSR), such as stopping to pick up coffee, a newspaper or to mail a letter. Stop time will be billed at 30 30-minute charge. Picking up additional passengers will also incur charges.

TOLLS: All round trip tolls are billed to the customer depending on the route chosen. Earth Limos and Buses will charge for all round-trip tolls to and from the designated destination. Toll charges are reimbursed to the driver. Earth Limos and Buses collect only the collected toll.

MEET AND GREET: Meet and Greet Airport Service is offered at no charge, however parking and waiting time charges (if incurred) will be billed to your account or credit card. The driver will be instructed to meet the passenger by at baggage claim or the escalator exit of customs with a sign that has his or her last name on it, the driver will then escort the passenger to the designated car location (Assisting with
the luggage).

BAGGAGE: Earth Limos and Buses will not be liable for loss or damage for contents thereof unless occasioned by lack of responsible care on the part of its drivers. Articles with sharp edges, oversized baggage, or that which might otherwise damage the vehicles will not be carried unless securely and
safely packaged. Explosives, inflammables, or harmful liquids will not be transported. Excess baggage other than hand baggage may be carried in an additional vehicle to be supplied by Earth Limos and Buses at the vehicle’s hourly rate.

LIABILITY: Earth Limos and Buses will not be liable for delays caused by an Act of God, public enemies, terrorism, authority of law, quarantine, perils of navigation, riots, strikes, traffic delays, and hazards or dangers incident to a state of war, accidents, breakdowns, bad road conditions, storms, and other conditions beyond its control, and does not guarantee arrival or departure from any point at a specified time. Earth Limos and Buses will endeavor to maintain the schedule in the charter order but the same is not guaranteed. If any of the above actions occur and make it, in the sole opinion of the Earth Limos and Buses, inadvisable to operate a vehicle either from the place of origin or any point en route, the Earth Limos and Buses shall not be liable therefore, or be caused to be held for damages for any reason whatsoever.

LIABILITY REGARDING ARTICLES OR ITEMS LEFT IN VEHICLES: Earth Limos and Buses will not be held liable for articles or items left in vehicles. We will make every attempt to locate and return your property but will not be liable for unsecured damaged items or if items cannot be found.

CELLULAR PHONE SERVICE: Cellular phone service may be available, upon request, for customers in all vehicles. Driver will record the start time and end time of the call placed. Charge for cell phone use will be at $2.00 per minute.

INFANT OR TODDLER SEATS: Earth Limos and Buses recommends that parents get their own infant or toddler seats however we can provide an Infant or toddler seats for an additional $15 per seat. Earth Limos and Buses are not liable for malfunctioning infant or toddler seats. Parents are required to install all toddler seats and infant seats including the booster seats. Please mention that you will need an Infant or Toddler Seats when you place your reservation.

CHILDREN UNACCOMPANIED: No person under the age of 21 will be permitted to take part in service unless a parent/guardian or other responsible adult over the age of 21 accompanies the minors. Minors over 15 will be permitted to take part in service (without adult supervision), if they can provide the Parent Consent Form signed by the parent or legal guardian. We define an adult as any person who is 21 years of age, or older who is responsible for the care and supervision of the child during the charter service.

GRATUITY: A 20% tip (gratuity) is added to every trip, there is no need to tip anything additional to the drivers unless you would like to.

GENERAL PROVISIONS: You and Earth Limos and Buses have agreed to these Service Terms within the State of Nevada, for all purposes.

All disputes arising out of, under, or in connection with these Service Terms (including without limitation, their validity, interpretation, performance, or breach) will be adjudicated exclusively in the federal or state courts located in (or having jurisdiction over) Clark County, Las Vegas. These Service
Terms and its validity and effect will be interpreted under, and governed by, the laws of Nevada, without regard to its conflict of law’s provisions. You expressly consent to the jurisdiction of such courts over you. You expressly waive any claim of forum non-convenience. You agree to reimburse Earth Limos and Buses for its legal fees and expenses of instituting (or defending) a lawsuit by (or against) you. These Service Terms (and any other operating rules or terms posted (including, without limitation, the Privacy Policy) constitute the entire agreement between Earth Limos and Buses and you, and supersede all previous written or oral agreements between Earth Limos and Buses and you. No action (or inaction) by Earth Limos and Buses may be construed as a waiver of these Service Terms (or any part). If any of the provisions of these Service Terms are held to be unenforceable by a court having competent jurisdiction, the remainder of these Service Terms will continue in full force and effect.
